Where on an application for a restraint order the court decided not to make one, the Director of Public Prosecutions may appeal to the Court of Appeal against the decision.
Where an application is made under section 46 (2) in relation to a restraint order or an order under section 45 (2) the Director of Public Prosecutions or an y person affected by the order may appeal to the Court of Appeal in respect of the court ’ s decision on the application.
On an appeal under subsection (1) or (2) the Court of Appeal may either confirm the decision or make such order as it believes is ap propriate.
