7. (1) Notwithstanding that any ship in respect of which an application for registration has been made is entitled to be registered, the Chief Executive Officer may direct the Registrar of Shipping not to register a ship if the Chief Executive Officer is satisfied that having regard to —
the condition of the ship so far as is relevant to safety or to a risk of pollution;
the safety, health and welfare of persons employed or engaged in any capacity on board the ship;
the possibility that the ship is being used for criminal or unlawful purposes; or
the record of the owner’s management and operational quality including in relation to the matters mentioned in paragraphs (a) to (c), it would be detrimental to the interests of the Islands or of international shipping for the ship to be registered.
If it appears to the Chief Executive Officer that a ship in respect of which an application for registration has been made is not entitled to be registered, having regard to the matters mentioned in subsection (1)(a), (b), (c) or (d), the Chief Executive Officer shall inform the applicant, or a representative person for the time being appointed in relation to the ship, and the Registrar of Shipping shall not register the ship.
